It clearly looks like the basis for this work is the original artwork. I think you should find a nice and expensive lawyer to represent you and let them sue, assuming they will be forced to pay all the fees for the lost case.

You should definitely NOT put “Cover Painting by Brittany Pyle (an homage to Roy Lichtenstein’s Kiss V)” in the liner notes, but credit the actual original for the homage. Fuck the estate.
